Kulaste had alleged that the police "have chosen not to Kulaste had alleged that the police "have chosen not to probe or reveal the call details of S P Gupta, Aman Arora and Lovely Singh, all prosecution witnesses, although co-accused Sohail Hindustani has categorically stated they were instrumental in introducing/conversing with Patel to make a deal to pay BJP 'venerable' MPs to vote in favour of the UPA". The police, however, told the court that the Congress leader had joined the investigation and made a statement denying allegations made by Hindustani and stated that no conversation took place between them on mobile of Lovely Singh. The police had also said that the call details of Lovely Singh were analysed and no call were found to have been made or received from the landline or mobile numbers of the Congress leader at the relevant time. The probe agency has also denied the allegation of the investigation being influenced by the Centre. Regarding the DVD procured from a news chanel containing the interviews of three BJP MPs and shots of currency notes, the court said that "the investigating agency for some unexplainable reasons has not carried out any investugation on the DVD which according to Kulaste shall bring out the hidden truth that some of the accused are only the whistleblowers and had engineered the sting to expose horse trading..." The court also rejected police's arguments that no further probe could be ordered at the behest of an accused after the filing of the charge sheet and "the application was merely seeking to cast aspersions on the probe agency by making wild allegations." On July 22, 2008, some BJP MPs had waved wads of currency notes on the floor of Lok Sabha during the trust vote faced by the UPA-I government, claiming they were given the cash to vote in favour of the Manmohan Singh government. Samajwadi Party's former general secretary Amar Singh, BJP leader L K Advani's former aide Sudheendra Kulkarni, BJP MP Argal, Kulaste, ex-party MP Mahabir Singh Bhagora along with Amar Singh's former aide Sanjeev Saxena and alleged BJP activist Suhail Hindustani are accused in the case.
